actor Priti Zeta She is the latest Bollywood star to get interim relief from the Bombay High Court in a case involving unauthorized use of her image, which she claimed “violated her personality, publicity and moral rights”.Justice Madhav Jamdar passed an interim order while hearing the suit on Wednesday, holding that misuse of such content does affect a person’s fundamental rights, Bar and Bench reported.According to the report, Zinta sought protection from social media intermediaries and directed them to remove AI-generated deepfakes, morphed images and other content that allegedly violated her personality and publicity rights.The court reminded online intermediaries of their obligation to conduct “due diligence” in accordance with the information technology rules governing digital platforms. Justice Jamdar also expressed concern over the role of intermediaries in curbing offensive and illegal content.The actress argued through her attorney Jai Munim that “deepfake images, artificial intelligence, superimposed visual effects and morphed images prima facie violate her moral, publicity and personality rights”. In her plea, Zinta asked the court to restrict “named and unnamed websites and people” from using her image for commercial or personal gain. The petition specifically seeks protection for the use of “her name, nickname, photograph, likeness, including her distinctive dimpled smile, caricature, voice, mannerisms, character or other personality traits in any form.”Zinta also expressed concern about AI-generated content and chatbot-style interactions impersonating her being posted online by alleged infringers.Her lawsuit further lists domain names in her name that she did not create. It said, “Personal characteristics are an integral/inherent part of his personality rights and/or publicity rights over which the plaintiff exercises (and should exercise) exclusive control.”While granting relief to the actress, the high court also said that if any infringement occurs in future, Zinta may contact online intermediaries including Google, Meta and X to seek removal of such content.
